Visitor Safety & Conduct Policy

This Visitor Safety & Conduct Policy applies to all markets organized, produced, or managed by Markets by Jess and its affiliated companies and limited liability entities, including but not limited to Real Food Boca, LLC, The Market Crew, LLC, Boca Farmers Market, Deerfield Beach Farmers Market, Cove Farmers Market and any current or future affiliated market concepts (collectively referred to as “Market Management”).By entering any market operated by Market Management, visitors acknowledge and agree to the following policies and conditions of entry.

 

Entry to the market constitutes acceptance of this policy.

 

Assumption of Risk

Farmers markets and outdoor events are active, temporary environments that may include:

• Tents, tent weights, stakes, and temporary structures

• Uneven pavement or surfaces

• Electrical cords, cables, generators, and equipment

• Cooking stations, grills, hot food, and hot beverages

• Live animals

• Exercise classes, demonstrations, and children’s activities

• Crowds and pedestrian traffic

• Folding tables, chairs, and temporary seating areas

• Weather conditions including heat, wind, rain, or lightning

 

By attending the market, visitors voluntarily assume all risks associated with their presence and participation, whether caused by negligence or otherwise. Market Management, including its affiliated LLCs, property owners, landlords, sponsors, certificate of insurance (COI) entities, employees, contractors, volunteers, vendors, and agents, shall not be liable for any injury, illness, damage, loss, or claim arising out of or related to attendance at the market.

 

General Conduct

• Visitors must behave respectfully and safely at all times.

• Visitors must follow instructions from Market Staff or property management.

• Disruptive, aggressive, or unsafe behavior may result in removal from the market. Market Management reserves the right to refuse entry or remove any individual creating a safety concern.

 

Children

• Children must be accompanied and actively supervised by a responsible adult at all times.

• Parents and guardians are fully responsible for the safety and conduct of minors in their care.

• Running, climbing on structures, entering vendor booths without permission, or interfering with equipment is prohibited.

 

Dog Policy

Well-behaved dogs are welcome under the following conditions:

• Dogs must be on a short, non-retractable leash (maximum 6 feet).

• Dogs must remain under the direct control of a responsible adult at all times.

• Dogs may not block walkways or enter vendor booths without permission.

• Owners must immediately clean up after their dogs.

• Dogs exhibiting aggression, lunging, snapping, excessive barking, or unsafe behavior must be removed immediately upon request by Market Management.

Dog owners assume full responsibility and liability for any injury or damage caused by their animal. Market Management and associated entities are not responsible for animal-related incidents.

 

Walkways, Tents & Equipment

Markets include temporary tents, weighted structures, cords, displays, and vendor equipment.

• Watch your step at all times.

• Do not climb on tents, tables, vehicles, or displays.

• Visitors use temporary seating and market furnishings at their own discretion.

• Do not tamper with tent weights, structural components, generators, or electrical setups.

• Report any safety concerns to Market Staff.

 

Food & Beverage Safety

Hot food, beverages, grills, and cooking equipment are present throughout the market.

• Handle hot items carefully.

• Supervise children near cooking areas.

• Use caution in crowded areas where spills may occur.

Market Management is not responsible for injuries related to food handling, hot surfaces, or spills​.  Food and beverages are prepared and sold by independent vendors. Vendors are responsible for their own food preparation, handling, storage, and compliance with applicable regulations. Any food-related concerns should be directed to the individual vendor. Market Management is not responsible for food preparation or consumption-related incidents.  Consumption of food or beverages is at the visitor’s own discretion and risk.

Activities & Classes

Markets may include exercise classes, wellness sessions, demonstrations, or children’s activities.

• Participation is voluntary and at your own risk.

• Participants are responsible for assessing their own physical condition prior to engaging in activities.

• Follow instructor and staff safety guidance at all times.

Market Management is not responsible for injuries resulting from voluntary participation in activities.

 

Weather Conditions

Markets operate outdoors and are subject to changing weather conditions.

• Visitors attend at their own discretion.

• In the event of high winds, lightning, or severe weather, visitors must follow staff instructions immediately.

• Market Management reserves the right to pause or close the market for safety.

Market Management is not responsible for weather-related incidents or environmental conditions.

 

Personal Property

Visitors are responsible for their personal belongings. Market Management is not responsible for lost, stolen, or damaged property.

 

Right to Refuse Entry

Market Management reserves the right to refuse entry or remove any individual who violates this policy or creates a safety concern.

This policy is intended to be interpreted broadly to provide maximum protection permitted under applicable law.  Entry to the market constitutes acceptance of this Visitor Safety & Conduct Policy.
